When a company goes through temporary financial difficulties and does not have enough work to keep its employees busy, it faces a difficult choice. Does it cut the wages of all workers or lay off some of its workers? Both of these options are hard on the company and the employees because they either reduce moral, which increases the chances of losing its best workers, or causes the company to lose one of its most valuable resources, its staff, an asset it might need soon if the company’s business situation improves.
What can you do if you are the owner of a small business or the employee of a business that is struggling to keep you busy? Residents in North Carolina have an option to consider in these circumstances: an attached claim.
What are attached claims?
Attached claims are a special type of unemployment benefit that can be used to supplement the wages of workers whose hours have been reduced because full time employment is no longer available. This allows companies to reduce the hardship to employees who see their work hours reduce and helps to maintain trained workers during difficult financial times.
Eligibility
To qualify for an attached claim you must work or be paid for less than three full time days of work or less than 60 percent of your normal full time wage and full-time work is temporarily unavailable for you. This program cannot be used for workers who were employed on a part-time basis or who choose to reduce their hours.
How to apply?
If you qualify for an attached claim you must ask your employer to claim for it on your behalf. Employers who apply for attached claims on behalf of their workers must complete and file the NCUI 501 form, Benefit Claim for Attached Worker. This form certifies the worker applying for benefits is still attached to the company but worked less than the 60 percent of his or her normal hours due to no fault of his or her own.
Employers can file for an attached worker through a variety of ways. They can apply over the telephone by calling 919.707.1237, by fax at 919.733.1371 or by filling a paper NCUI 501 form.
However, if you are an alien worker, you have a federal civil or military service wages or have worked in another state during the last year, your employer must provide you with a NCUI 501 paper form so you can go to your closest Employment Security Commission Office to file the claim directly. This is because it is likely that eligibility issues will come up and you will need to provide extra information to file your claim.
